Consumer Rights
Right of withdrawal, contracts and debt collection in Gibraltar.
Consumer protection in Gibraltar is governed by the Consumer Protection Act 2006 and the Sale of Goods Act (Gibraltar), broadly modelled on UK consumer law. Rights include: protection against unfair contract terms, right to return faulty goods, distance selling protections, and protection from misleading advertising. The Gibraltar Consumer Affairs Office under the Ministry of Commerce handles consumer complaints and enforcement.
Right of withdrawal (Widerrufsrecht)
14 days from receipt of goods (or contract conclusion for services) for online and remote purchases. Applies to most consumer contracts. Does not apply to: custom-made goods, opened hygiene items, digital content after download starts, travel/hotel on a fixed date. Send cancellation in writing (email is sufficient) within 14 days. Seller must refund within 14 days of receipt of goods. Original outbound shipping must also be refunded.
Contract cancellation
For faulty goods under the Sale of Goods Act: right to repair, replacement, or refund within a reasonable time. Right to a full refund within 30 days of purchase for faulty goods. After 30 days: right to repair or replacement (seller's choice). After one failed repair: right to a price reduction or final refund. Gym, phone, and energy contracts: typically 30 days cancellation notice. Always read your contract terms for notice periods.
Many Gibraltar service contracts (broadband, mobile, gym) auto-renew. Providers must give reasonable notice before auto-renewal. If not informed of auto-renewal: you may have grounds to cancel without penalty. Check your contract carefully.
Debt collection — response deadlines
Informal reminders: First informal reminder → Second notice with interest → Third notice threatening legal action → Formal letter before action from solicitor.
Court order: Creditor may obtain judgment from the Gibraltar Magistrates Court or Supreme Court. Enforcement via wage attachment, bank account seizure, or charging order on property.
Response deadline: Respond to any formal legal notice or court letter within the stated deadline (typically 14–21 days). Ignoring court letters results in automatic judgment against you.
