Maternity, parental leave and child benefits in Gibraltar.
Family rights in Gibraltar are governed by the Employment Act 2006, the Matrimonial Causes Act, and the Children Act (Gibraltar versions), broadly following English family law principles. Statutory maternity and paternity leave apply to all employed parents. Child benefit is available through the Gibraltar Social Insurance Office. Free state education (age 4–18) and subsidised GHA healthcare for families are significant practical benefits. Gibraltar's compact, safe community environment is a major draw for families with children.
Statutory Maternity Leave (Gibraltar)
Before birth: Maternity leave can begin up to 11 weeks before the expected due date. Employee must notify employer at least 15 weeks before the expected due date. Maternity leave is a minimum of 14 weeks under the Employment Act 2006. Many Gibraltar professional employers (financial services, iGaming) offer enhanced packages of 26–52 weeks.
After birth: Minimum 14 weeks total maternity leave. Statutory Maternity Pay: first 6 weeks at 90% of average weekly earnings; remaining 8 weeks at the statutory pay rate (reviewed annually by SIO). Enhanced maternity pay (full salary for 26+ weeks) is common in Gibraltar's professional sector — always review your employment contract.
Job protection: Job protection applies throughout statutory maternity leave. Returning to the same job (or a suitable alternative if not reasonably practicable) is a legal right. Dismissal related to pregnancy or maternity leave is automatic unfair dismissal with no qualifying period. Contact the Department of Employment and Training (DET) or a Gibraltar employment lawyer if rights are infringed.
Paternity / Shared Parental Leave (Gibraltar)
Max duration: Statutory paternity leave: 2 weeks paid. Must be taken within 8 weeks of birth. Paid at the statutory rate. Enhanced paternity leave of 2–4 weeks at full pay is common in Gibraltar's professional sector. Gibraltar has not implemented UK-equivalent Shared Parental Leave legislation — check your employment contract for any enhanced shared leave provisions.
Split rules / Elterngeld: Paternity leave must be taken as a block of 1 or 2 consecutive weeks (cannot be split into single days). Must be taken within 8 weeks of the child's birth. Notify your employer at least 15 weeks before the due date.
Benefits
Gibraltar Child Benefit
£8.70/week per child (verify 2026/27 current rate with the Gibraltar Social Insurance Office — rates are reviewed annually and the 2025 budget increased many social security payments)
Duration: From birth until child leaves full-time education (up to age 18, or 19 if in further education)
Eligibility: Resident families with children in full-time education. Both parents must be ordinarily resident in Gibraltar. Child must live in Gibraltar. Paid by the Gibraltar Social Insurance Office (SIO).
How to apply: Apply at the Gibraltar Social Insurance Office (SIO), Europort. Required documents: birth certificates for children, proof of Gibraltar residency, social insurance numbers for both parents, bank account details for payment.
Gibraltar child benefit (£8.70/week) is more modest than UK Child Benefit (£25.60/week in 2026). However, Gibraltar's no-VAT environment, free state education, and GHA healthcare offset this. Some families also retain UK Child Benefit entitlement if they have qualifying ties — seek tax advice.
Statutory Maternity Pay (SMP)
90% of average weekly earnings for first 6 weeks; statutory rate for remaining 8 weeks
Duration: 14 weeks total statutory entitlement
Eligibility: Employed mothers who have paid sufficient SIO contributions and meet qualifying employment conditions.
How to apply: Request SMP from your employer. Employer pays SMP and recovers from the SIO/government. Provide employer with your MATB1 maternity certificate (issued by GHA midwife or GP at 20+ weeks).
Statutory Paternity Pay
Statutory rate (£116.75/week or 90% of average weekly earnings if lower — 2026)
Duration: 2 weeks
Eligibility: Employed fathers or partners who meet qualifying employment and contribution conditions.
How to apply: Notify employer of paternity leave intention 15 weeks before the due date. Employer pays statutory paternity pay.
Sick child leave
There is no standalone statutory "sick child leave" provision in Gibraltar equivalent to some EU countries. In practice, parents take annual leave or agree informal arrangements with their employer for short absences to care for sick children. Some employment contracts in professional sector include emergency dependant care provisions — check your contract. Discuss arrangements with your employer early.
Birth registration
All births must be registered within 42 days at the Gibraltar Civil Status and Registration Office (CSRO), John Mackintosh Square. Required: both parents' passports/ID, marriage certificate (if married), or statutory declarations (if unmarried). The CSRO issues a Gibraltar birth certificate. Childcare rights
Free government nursery places for children aged 3–4 years. Free state school from age 4–18. After-school care is available through private providers (£150–300/month). Gibraltar's compact size means logistics are simpler than in larger cities — most schools are within walking distance or a short taxi ride.
