Gibraltar is a British Overseas Territory — it is NOT part of the EU or the Schengen Area. UK citizens have an automatic right to live and work in Gibraltar. EU/EEA/Swiss citizens who were resident before 31 December 2020 have Settled or Pre-Settled Status under the Gibraltar EU Exit Scheme (GEES). New EU/EEA arrivals post-Brexit require a work permit or residency permission. Commonwealth citizens, US, Canadian, and Australian nationals can visit visa-free for up to 6 months but require a work permit to work.
Post-Brexit, Gibraltar's immigration status is complex and distinct from the UK's own immigration rules. Gibraltar is not part of the UK's standard immigration framework — it operates its own system. The Gibraltar-Spain border (La Línea frontier) remains subject to ongoing UK-EU treaty negotiations; EU citizens crossing regularly between Gibraltar and Spain should carry GEES documentation. There is no Schengen visa requirement for Gibraltar itself, but entering mainland Spain from Gibraltar requires Schengen status (EU passport, Schengen visa, or ETIAS once implemented). For Category 2 status, specialist Gibraltar law firms (e.g., Hassans, Isolas, Triay & Triay) are strongly recommended.
